The High Court in London has ruled in the case against Playables Ltd and declared the sale, import and advertising of DS cartridge devices illegal.
Nintendo bought the action, it states, to support the development companies against piracy. The counter argument from Playables Ltd. and defendant Wai Dat Chan was that the purpose of the device was to allow users to play homebrew software. Evidence presented to the court that the devices circumvented Nintendo’s security systems. The company has been told to stop selling the devices with immediate effect.
This follows a similar judgement in The Hague last week, when Nintendo won a case against 11 retailers selling hardware for Wii and DS.
